Terms and Conditions

These Terms govern the relationship between Free Range Websites ("we", "us", "our") and you, the client ("you", "your"). By submitting your intake form and confirming your agreement, you accept these Terms in full.

Free Range Websites is a trading name operating under Australian law. All services are provided in Australia and governed by the laws of the State of Victoria.

1. The Service

Free Range Websites provides a monthly website subscription service. Your subscription includes the design, build, hosting, and ongoing maintenance of a static website as described on our pricing page. Made to Order is also available for clients requiring custom functionality — this is quoted individually and incorporates these Terms unless otherwise agreed in writing.

The specific inclusions for each plan are detailed on our pricing page at freerangewebsites.com.au. Plan inclusions are incorporated into these Terms by reference.

These Terms form the entire agreement between you and Free Range Websites. The agreement is formed at the point you submit your intake form and confirm you've read and agree to these Terms, at which time these Terms are presented and accepted in full.

We reserve the right to update plan inclusions with 30 days written notice. Existing subscribers will not have inclusions removed within a billing cycle.

Your privacy is important to us. Information about how we collect, use, and store your personal information is set out in our Privacy Policy.


2. Care Plan Billing

2.1 Free Build, First Payment at Launch

Your website build is completely free — no setup fee, no deposit, and no card details are required to apply. Your first payment of $199 is only collected once you've reviewed and approved your site and it goes live.

Because nothing is charged until your site goes live, there is no setup fee or deposit to refund. If you don't love the finished site, you simply walk away — you owe nothing.

You get a 7-day review window after your site is ready, with unlimited changes, before you approve and pay anything — see Section 3.4. If you're not happy with the finished site, you walk away owing nothing; there's no charge to refund because nothing was collected upfront. Once you approve the site and your first payment is processed at go-live, standard subscription terms apply (see Section 10 for cancellation).

2.2 GST

Free Range Websites is not currently registered for GST. All prices listed — including the $199/month Care Plan and any additional charges — are in Australian dollars and are GST-free. If our GST registration status changes, we will provide 30 days written notice and update our pricing accordingly.

2.3 Monthly Subscription

Your first Care Plan payment is processed on the date your site goes live, and renews automatically on that same date each month via Stripe until cancelled in accordance with Section 10. By approving your site for launch, you authorise this recurring charge to continue until a valid cancellation notice is received.

2.4 Price Changes

We may adjust subscription pricing with 30 days written notice sent to your registered email address. You may cancel within that 30-day window under standard cancellation terms if you do not wish to continue at the new rate. If we don't hear from you, we'll take that as confirmation you're happy to continue at the updated rate.


3. The Build Process

3.1 Intake Form

The build begins when you complete our intake form in full. This form collects your business name, services, primary suburb and service areas, contact details, logo, and any photos you wish to use. The accuracy and completeness of this information is your responsibility. Delays in completing the intake form delay the build — our quoted turnaround times begin from the date we receive a complete submission.

3.2 Turnaround Time

Your site will be ready for you to review within 5 business days of us receiving your complete intake form. If we miss this deadline, your first month's Care Plan is free. From there, you have a 7-day review window with unlimited changes before approving your site to go live — see Section 3.4.

3.3 Page Scope

Each plan includes up to 5 pages. A page is defined as a distinct URL with its own content.

Each page is scoped to a maximum of 6 content sections. A content section is a distinct visual block — for example: a hero banner, a services list, a testimonials block, or a call-to-action. Content that exceeds 6 sections per page is outside the build scope and will be treated as a content update request post-launch, or quoted separately.

Additional pages beyond your plan's page allowance are not included and must be quoted separately.

3.4 The Review Window

Once your site is ready to review, you have 7 days to request changes — and there's no limit on how many rounds of feedback you send during that window.

To keep things moving efficiently, please batch your feedback into a single consolidated list per round rather than sending changes one at a time across multiple messages:

  • One consolidated list of change requests submitted in a single email or message
  • Staggered feedback sent across multiple days does not constitute a single round and will be held until collated and resubmitted as one

Once you provide sign-off via clear written confirmation, the review window closes, your first Care Plan payment is processed, and your site goes live within 24 hours. Any further changes after sign-off are treated as content update requests under your subscription — see Section 5.

The review window applies to refining the site we've built for you, within the scope of your plan (see Section 3.3 for page/section scope). Requests that amount to a full redesign or significantly new scope may be treated as out of scope — see Section 3.5.

3.5 Creative Direction and Design

Free Range Websites retains creative discretion over layout, typography, colour application, and visual design decisions. We will work with your brand colours and assets, but we do not offer open-ended design customisation or full redesigns based on subjective preference.

Requests that amount to redesigning the site from scratch — rather than refining the existing design — are outside scope and will be declined or quoted separately.

3.6 Abandoned Builds

If we are unable to progress the build due to non-response from you, the following applies:

  • After 21 days without a response to our communications, the build is placed on hold
  • After 60 days without a response, the job is closed and your build slot is released
  • If you wish to recommence after a job has been closed, you'll need to reapply and start the process again, subject to spot availability at that time

4. Client-Supplied Content

4.1 Your Responsibility

You are responsible for supplying accurate, complete, and lawful content including business name, services offered, contact details, ABN (if displayed), service areas, and any other factual information that appears on your site.

Free Range Websites publishes content that you approve. We are not responsible for errors, inaccuracies, or misleading content that you have reviewed and signed off on.

4.2 AI-Assisted Copywriting

We use AI tools to draft website copy on your behalf based on the information you provide. This copy is prepared as a starting point for your review — not a final, verified product. You are responsible for reviewing all copy for accuracy before sign-off. This includes but is not limited to: your services, pricing, service areas, qualifications, and contact details.

Once you sign off on the copy, Free Range Websites is not liable for inaccuracies or omissions.

4.3 Logo and Branding

Logo design and brand identity work are not included in any plan and are not offered as a service by Free Range Websites.

You are responsible for supplying a logo file (PNG with transparent background preferred) and brand colours (hex codes if known). If no logo is supplied, we will use a text-based wordmark as a placeholder.

4.4 Photography and Images

You are responsible for supplying any photos of your work, team, or premises that you wish to use on your site. If you do not supply photos, we will source free, royalty-free stock photography from sources such as Unsplash or Pexels, or use AI-generated imagery where appropriate.

If you supply photos, you confirm that you own or have the right to use them.

4.5 Open Graph Image

Your plan includes Open Graph social share tag setup. This requires a social share image (1200×630px). If no image is supplied, we will create a simple branded text-based fallback using your business name and brand colour.

4.6 Google Business Profile Setup

Google Business Profile setup is included in your plan. We request Manager access to your Google Business Profile — you will receive an invitation to approve. You are never required to share your Google account password with us.

New profiles may require verification by Google, which can include a postcard sent to your business address. This verification process is outside our control. Go-live is not dependent on GBP verification completing.

Free Range Websites is not responsible for the outcome of Google's review, verification, or any suspension of your Google Business Profile.


5. Content Updates

5.1 What a Content Update Is

A content update is a change to existing content on your live website. Examples include: updating your phone number, changing service descriptions, swapping a photo, adding a testimonial, or amending your service area list.

5.2 What Is Not a Content Update

The following are not content updates and are not included in any subscription plan:

  • Adding new pages to the site
  • Redesigning the layout or structure of existing pages
  • Adding new sections beyond the original scoped structure
  • Changing the overall visual design, colour scheme, or typography
  • Logo design, graphic design, or any design work
  • Building new functionality (booking systems, e-commerce, custom forms)

5.3 What Constitutes a Round

A content update round is one batch of change requests submitted in a single, consolidated email or message. Requests submitted across multiple messages over several days do not constitute a single round — they will be held and counted as a new round when resubmitted together.

We will not begin work on a partial or staggered list.

5.4 Unlimited Updates (Fair Use)

Subscribers receive unlimited content update rounds, subject to fair use. Fair use means updates are for maintaining and improving existing content — not for continuous redesign or scope expansion. Requests should be batched and consolidated before submission.

5.5 Turnaround on Content Updates

We aim to complete standard content update requests within 3–5 business days of receiving a complete, consolidated request. Turnaround is not guaranteed and may vary during peak periods.


6. Search Engine Optimisation (SEO)

6.1 What Is Included

Unique page titles and meta descriptions, mobile-optimised responsive design, fast load times via Cloudflare CDN, SSL certificate, contact form and click-to-call button, correct heading structure, descriptive image alt text, Google-crawlable standards-compliant HTML, suburb-targeted copy, LocalBusiness structured data markup (JSON-LD), Google Business Profile setup, Google Search Console setup and sitemap submission, Google Analytics (GA4), Open Graph and Twitter Card tags, and a Google Reviews widget (subject to Section 6.3).

6.2 What Is Not Included

The following are not included in any plan:

  • Off-site SEO (link building, directory submissions, citation building)
  • Ongoing ranking campaigns or SEO management
  • Google Ads or any paid advertising
  • Social media management or content creation
  • Guaranteed search rankings, page positions, or traffic volumes

We do not guarantee any specific Google ranking outcome. Search engine rankings are determined by Google's algorithm, which is outside our control.

6.3 Google Reviews Widget

The Google Reviews widget is powered by the Google Places API. It will only be installed if your Google Business Profile has a minimum of 3 published reviews at the time of build or upgrade.

On cancellation, the API project will be disabled and the widget will be removed. On a code buyout, the API key will be replaced with a new key under your own Google Cloud account. Our API project will be disabled 10 business days after the buyout is completed.


7. Hosting, Infrastructure, and Uptime

7.1 Hosting Infrastructure

Your website is hosted on Cloudflare Pages, with site files stored and deployed via GitHub. Hosting is included in your subscription for the duration of your active subscription.

7.2 Uptime

We do not offer a guaranteed uptime SLA. Your website's availability depends on Cloudflare Pages and GitHub, both of which are outside our direct control. You can check live infrastructure status at cloudflarestatus.com and githubstatus.com.

7.3 Our Response Commitment

Where an issue is within our control to resolve:

  • Emergency issues (site completely offline): response within 1 business day
  • Standard issues (broken image, form issue, display problem): response within 1–3 business days

7.4 Reporting an Issue

To report an issue, email [email protected] with a description and screenshot where possible. Issues reported via social media or phone cannot be tracked or prioritised.


8. Domains

8.1 Domain Information — Required Upfront

Domain details are collected as part of your intake form at sign-up. Free Range Websites is not liable for launch delays caused by late or incomplete domain information.

8.2 Domain Pointing — Client-Owned Domains

Connecting your existing domain to your Free Range Websites site is included at no charge. Our preferred method is a nameserver transfer to Cloudflare. If you prefer to keep your registrar's nameservers, we will provide the DNS records to add yourself. We do not require login access to your domain registrar.

8.3 DNS Propagation

DNS changes can take up to 48 hours to fully propagate. This is outside our control.

8.4 Existing Live Websites

We will not change your DNS settings until you have signed off on your new site and confirmed you are ready to switch. Once DNS is switched, your old site will no longer be accessible at that domain. Back up any content you need before the switch.

8.5 Domain Registration on Your Behalf

If you do not own a domain, we can register one for $35 per year. Domains are registered via VentraIP using your name and ABN as the registrant — you own it from day one. For .com.au domains, an Australian ABN or ACN is required.

8.6 Domain on Cancellation

If your domain was registered by us on your behalf, it will be transferred to your direct control upon cancellation within 5 business days of your subscription ending.


9. Intellectual Property and Ownership

9.1 Website Code

The website code — including HTML, CSS, and JavaScript files — remains the intellectual property of Free Range Websites for the duration of your subscription. You do not own the code by virtue of paying a subscription.

9.2 Your Content

All content you supply — including text, images, logos, and business information — remains your property. You grant Free Range Websites a licence to use your content solely for the purpose of building and maintaining your website.

9.3 Code Buyout

You may purchase the website code outright at any time during your subscription — there is no minimum tenure. The buyout is available from day one.

  • Standard Free Range builds: flat price of $1,800
  • Made to Order builds: quoted individually, reflecting the custom functionality involved

Purchasing the code transfers ownership of the codebase to you. After purchase, you may self-host or engage another developer.

The buyout option does not automatically arise on cancellation. If you wish to purchase the code after cancelling, you have 30 days from the date your subscription ends to request a buyout — see Section 10.4 for full details.


10. Cancellation

10.1 How to Cancel

You may cancel at any time by sending a written request to [email protected]. Email is the required method.

Notice period: 30 days from the date your cancellation email is received.

10.2 During the Notice Period

Your site remains live during the 30-day notice period. Content update rounds continue as normal under your plan entitlements.

10.3 After Cancellation

At the end of the 30-day notice period, your subscription ends, your website is taken offline, and your hosting is terminated. Your domain name remains yours and will be transferred to your control.

10.4 Code Buyout on Cancellation

Cancellation does not automatically entitle you to the website code. You must request a buyout in writing within 30 days of your subscription ending. On day 31, all website code, files, and associated data are permanently deleted. This deletion is irreversible and no exceptions are made.


11. Acceptable Use

You agree not to use your Free Range Websites website to:

  • Publish false, misleading, or defamatory content
  • Engage in or facilitate any unlawful activity under Australian law
  • Infringe the intellectual property rights of any third party
  • Publish content that is discriminatory, harassing, or harmful

Free Range Websites reserves the right to suspend or take offline any website that violates these conditions, without notice in serious cases, or with 48 hours written notice otherwise.


12. Limitation of Liability

12.1 No Guarantee of Outcomes

Free Range Websites does not guarantee any specific business outcome from having a website, including enquiry volume, phone calls, leads, revenue, or search engine rankings.

12.2 Liability Cap

To the maximum extent permitted by Australian law, Free Range Websites' total liability to you for any claim is limited to the total fees paid by you in the 3 months preceding the claim.

12.3 Exclusion of Consequential Loss

Free Range Websites is not liable for any indirect, consequential, or special loss, including loss of revenue, profit, business opportunity, or third-party data.

12.4 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any right or remedy implied or imposed by the Australian Consumer Law that cannot be excluded or limited by agreement.


13. Disputes

If you have a complaint, contact us at [email protected] first. We will respond within 5 business days and work in good faith to resolve the issue. If the matter cannot be resolved directly, both parties agree to attempt mediation before pursuing formal legal action.


14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to active subscribers via email with 30 days notice. Continued use of the service after the notice period constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of Victoria.
